RELEASE OF LIABILITY
- RELEASED ACTIVITY. On premise, (property, job site – the premise location) solar powered, off grid cellular security surveillance stations and/or cameras used for monitoring project progress and commissioned as a potential theft deterrent of said premise. The security surveillance station shall offer live and/or cloud storage monitoring of the premises without any defined or expected Quality of Service (QoS) agreement. Due to many circumstances that may be outside of either party’s control or ability, service will be provide as a best effort QoS for the related activity.
- RELEASE. The customer agrees to hold the 3D Skies harmless against any and all future claims for the following:
– Theft of any kind regardless of item(s), value or quantity
– Property damage of any kind great or small
– Vandalism of any kind
– Injury of any kind including death or dismemberment
– Loss of income, regardless of how great or small
– Other: All other items not mentioned above - WAIVER OF CLAIMS. In consideration of the covenants, agreements, and undertakings expressed herein, both parties, including their families, heirs, employees, contractors, agents, and successors, agree to irrevocably release each other from any past, present, or future claims or liabilities without admitting any wrongdoing related to the Released Activity, unless otherwise determined by section 7 below. This waiver settles all disputes related to any potential injuries or damages and is considered legally binding upon its execution and prevents any further claims by any parties or their successors.
- GOVERNING LAW. This Release shall be governed under the laws of the state of Arizona where the Released Activity occurs (the Released Premise).
- NO GUARANTEE. Security stations are offered as a deterrence and are not a guarantee that loss, theft or damages will never occur.
- GUARANTEE. 3D Skies guarantees the workmanship and craftsmanship of the security stations and will make a best attempt to repair or replace any part or station collectively within 24 hours, and certainly within 48 hours of equipment failure due to normal wear and tear. Damaged items, as defined in section 7 are not covered under any guarantee.
- DAMAGES. The customer is not responsible for any loss or damages specifically to the security surveillance stations unless it is determined that such a vendor, contractor, staff member, family member, associate, hired person or any entity related to the client is responsible for such loss or damages, as proven with evidence from the security stations directly or other witness therein. The value of damages will be assessed and itemized at the time of occurrence.
